7 Reasons Why Your Small Canadian Business Needs an AI Policy

If your small business is using, or even just thinking about using AI tools like ChatGPT, Google Gemini, Claude, or whatever tomorrow’s shiny object is, you need an AI policy. Not because it’s trendy. Not because your lawyer said so. Because not having one is like handing your business keys to a robot and crossing your fingers it doesn’t start changing the locks or emailing your clients behind your back.
AI is not some distant, high tech utopia thing anymore. It’s in your inbox, in your customer service, in your hiring process, in your documents. Sometimes, it’s even writing your social posts while you sleep. And if you're not setting the ground rules for how AI is used in your business, you're playing Russian roulette with client trust, compliance, and your team’s productivity.
So, let’s talk straight. Here’s why your small business needs an AI policy - and fast.
1. Your staff is already using AI (Even if you didn’t approve it).
Surprise: You’re probably already using AI. No formal process, no oversight, no tracking. Just Susan in marketing casually pasting customer data into a free AI tool because it “saves her time.” Meanwhile, Carl from HR is using it to generate employee contracts, and you don’t know where that sensitive data is going.
AI tools are absurdly easy to access. That’s the problem. There’s no gatekeeping, no alerts, no flashing “Hey, your company’s reputation is now in the hands of an unpaid bot” warning.

2. There are legal landmines everywhere.
AI doesn’t 'get' Canadian privacy laws. Or GDPR. Or copyright rules. But you have to. AI tools absorb and remix content from all over the internet. If your business is publishing or relying on AI-generated content, you need to think about:

In Alberta and BC, provincial privacy laws under PIPA and FOIP regulate how personal data is handled. Employers must ensure no personally identifiable information is submitted to public AI tools without proper consent or safeguards.
In Ontario, privacy rules are still governed federally under PIPEDA, but specific rules are evolving quickly.
You don’t need a 20-page legal treatise. But you do need some common-sense rules in writing that show you're not recklessly letting AI run wild in your business.
3. It’s the wild west in hiring and it’ll bite you.
Are you using AI in hiring? Even a little? Resume screening? Job ad writing? Interview scripts?
AI can help - but it can also amplify bias, screen out candidates unfairly, and leave you wide open to discrimination claims. And good luck explaining to a rejected applicant that a robot made the decision.
Important Canadian note: Ontario passed Bill 149, which will soon require employers with 25 or more employees to disclose in job postings if AI is being used to screen, assess, or select applicants. This takes effect January 1, 2026. It’s a first-of-its-kind law in Canada. Alberta and BC don’t yet require disclosure, but privacy compliance still applies.
