Understanding how to apply Bill 47 so soon after Bill 148 was passed can be confusing. Our Ontario Bill 148 and Bill 47 comparison table summarizes what you need to know about the changes to the Employment Standards Act, 2000 (ESA) and the Labour Relations Act, 1995 since Ontario Bill 47, the Making Ontario Open for Business Act came into effect resulting in significant changes to Bill 148, the Fair Workplaces, Better Jobs Act, 2017.  

Amendments made to the ESA were effective January 1, 2019. Amendments to the LRA were effective November 21, 2018.

What is Bill 148?

In November 2017, Ontario Liberals passed the Fair Workplaces, Better Jobs Act, more commonly referred to as Bill 148. The bill implemented a huge overhaul of government regulation in the workplace. It was widely criticized by employers to be burdensome due to the imposition of  costly provisions to Ontario’s employment and labour laws, making significant changes to the Employment Standards Act and the Labour Relations Act. What is Bill 47?

In November 2018, now under a conservative government, Ontario passed the Making Ontario Open for Business Act, also known as Bill 47. The stated purpose of Bill 47, Making Ontario Open for Business Act, 2018, is to make Ontario employment and labour more accessible and straight-forward. The new provisions make it easier for workers to find jobs and provide an easier hiring process for businesses.

The extensive effect of Bill 47 was to undo most, but not all of the legislation that had been introduced in Bill 148, consequently reversing many of the changes to the Employment Standards Act and the Labour Relations Act.
